Phoenix Process Servers Perform A Vital Function

By Amanda Bennett

The legal system is very complex. There are numerous rules and regulations that govern the judicial process. This is one of the reasons why it often takes so long for a case to actually go to court. The system is designed to be fair towards all parties. For example, it is the duty of the court to make sure that all parties involved in a specific case receive all the documents relevant to that case. This is where Phoenix process servers play a very important role.

It is not possible to lay a complaint against someone, or to sue a person without the other party being informed officially of that fact. To this extent all official documents related to the case has to be served on the intended recipient. This used to be left to the sheriff department, but it soon became a huge burden on their time and resources. These days the job is done by professional servers.

Serving legal documents has become a career choice. Serving professionals deliver legal documents in person to individuals, courts, businesses, other organizations and legal offices. In every case it is the duty of the server to obtain written proof that the documents have been delivered to the correct recipient. This proof has to be presented to the court and is necessary before a case can proceed.

The job of a server most certainly does not entail the simple issue of serving a document to the correct person at a given address. Many people avoid being served and serving professionals often have to go to great lengths to locate the intended recipients. People may have moved to a different town, or state or even another country. In such cases the delivery of the documents may take some time.

Confronting an individual in order to serve papers can easily turn into a dangerous situation. There have been many cases where serving professionals have been physically manhandled and even injured. In such cases the police may be approached for help but they are often reluctant to do so unless violence has already occurred. Luckily, a few states allow for the serving to be done on another responsible adult that can be trusted to hand over the documents.

Strict trespassing laws also make things extremely difficult for serving professionals. It is against the law to to trespass on a private property, even for the purpose of serving legal documents. In the modern security minded environment with so many gated communities, high security buildings and advanced residential security it is often extremely difficult to come face to face with the intended recipient.

The requirements for becoming a licensed serving professional differs from state to state. In some states formal training must be completed. In most states applicants must have a clean criminal and credit record. Many retired police officers and private investigators become successful serving professionals. They have experience in locating people and they know how to handle potentially explosive situations.

An astonishing number of legal documents have to be served each year. Unless these documents are served, the legal process simply cannot proceed. A dedicated and professional server therefore plays an important role in helping to keep the wheels of justice turning.
